Challenge
A particularly big challenge is the introduction of a preventive system that will in some way influence public enterprises and local self-government to fulfill their legal obligations, duties and supervision over the implementation of duties.
The idea for the procedure itself was initially aimed at determining the liability of the defendants, who have legal obligations to ensure appropriate treatment of stray dogs in order to reduce damages of this kind, and thus regulate the safety of citizens in public areas.
We always start the procedure with claims for damages, but given that the institutions are not in the mood for an out-of-court settlement of the dispute, the procedure ended this time in Court. The claim was Directed towards those responsible, and in communication with experts, we set the amount of the claim that is correlated with the injuries and the mental pain and suffering suffered by the injured party.
After providing the evidence and expert opinions in a short time interval, the lawsuit was filed with the Basic Civil Court in the Court. With the lawsuit, we requested that the injured party be compensated for non-material damage and medical expenses. Written and verbal material evidence was presented.
The first-instance procedure ended positively in favor of the injured party, with fair monetary compensation for damages. After an appeal was filed by the defendants, the Court of Appeal rejected the appeals and upheld the first-instance verdict.
